Timothy J. Pastore is a partner in the Litigation Department.  Previously, Mr. Pastore was a partner at a large, national firm.

 

Before entering private practice, Mr. Pastore was a decorated officer and Judge Advocate (JAG) in the U.S Air Force and a Special Assistant U.S Attorney with the U.S. Department of Justice.

 

In the public and private sector, Mr. Pastore has handled a wide variety of matters before federal, state and military courts in many jurisdictions across the country and internationally.

 

Currently, Mr. Pastore represents large corporate clients in various industries, including banking and finance, commercial real estate, asset management, special servicing, electronic security, telecommunications, food-service, entertainment and others.

 

Mr. Pastore has been lead counsel in matters involving commercial mortgage repurchase claims, non-compete agreements, loan defaults, employment and disability discrimination, land use disputes, negligence defense, deceptive trade practices, unfair competition, tortious interference, product liability, trade secrets, lease disputes, commercial mortgage foreclosures, broker fee claims, and other commercial disputes.

 

Recent matters include:

  • Represented trustee and special servicer of a $4 billion trust in an action for breach of representations and warranties in connection with the sale of a certain $81,000,000 commercial mortgage loan.
  • Represented beneficial owner of a commercial office building in an action against an adjoining land owner for money damages, declaratory relief and attorneys’ fees in connection with the defendant’s willful obstruction of development and rezoning.
  • Defended commercial real estate developer against various claims brought by an easement holder concerning access rights to a private road encircling a commercial shopping mall.
  • Pursued various business-protection claims such as improper solicitation of customer accounts, theft of trade secrets and customer lists, and violation of non-compete and other employment agreements.
  • Various matters counseling prospective buyers of commercial real property about particular litigation risks affecting investment and development opportunities.
