The Bankruptcy Practice Group makes the Firm the ideal choice for clients that become involved in bankruptcy/insolvency matters. The group's leader - Kirk Brett - has a proven track record of successfully navigating our clients through the uncertainties of the chapter 11 bankruptcy process. A highly versatile lawyer, Mr. Brett is accustomed to serving as both a transactional and litigation attorney in dealing with financially distressed businesses or real estate. He is skilled in the art of developing and implementing strategies for creditors, lenders or acquirers, and he routinely negotiates consensus among competing interests under difficult economic or other situations -- but if circumstances require it, Mr. Brett is equally comfortable in engaging in litigation through trial and all appeals in order to achieve the client's desired result. Mr. Brett has represented active parties-in-interest in numerous high-profile bankruptcy cases including (1) significant real estate cases (such as Rockefeller Center Properties), (2) major energy cases (such as Enron, NRG, Mirant and Northwestern), (3) major retail bankruptcy cases (such as Kmart, Caldor and Accessory Place), (4) financial institutions (including Refco and Integrated Resources), (5) healthcare cases (such as United Hospital), and (6) major telecommunications cases (such as WorldCom, AppliedTheory Corporation, Amnex, Inc., and ETS Payphones, Inc.).
