Mark Mako serves as Of Counsel to the Firm’s Real Estate Practice Group. Mr. Mako’s practice covers all aspects of commercial real estate law with concentration in the areas of acquisitions and dispositions, lease transactions and commercial lending. In particular, he has represented private property owners in the acquisition, sale and lease-up of several properties in the U.S., commercial lenders in the structuring, negotiation and documentation of mortgage, construction and project loans, including, workouts, loan modifications and restructurings, and tenants in the negotiation of commercial office and retail lease space. In addition, Mr. Mako has represented both public entities and private developers in New Jersey land use and zoning matters and has appeared before planning and zoning boards of many New Jersey municipalities and governmental agencies.
Mr. Mako’s representative transactions include: (i) represented a commercial lender in the restructuring and modification of $200 million in mortgage, construction, and project loans, which resolved several issues surrounding New York mortgage recording taxes; cross-collateralization, cross-default, and reserve requirements; and guaranty obligations; (ii) represented a wireless communications equipment and service provider in the negotiation of 12 retail leases in the New York metropolitan area, which leases were finalized within the provider’s stringent 2 month deadline while remaining compliant with its corporate standards; and (iii) represented a commercial lender in the restructuring of an $80 million mortgage facility secured by theaters in New York and California, which resolved certain guaranty, cross-collateralization, and release requirements.
Prior to joining the Firm, Mr. Mako practiced law at several recognized law firms, including the real estate practice group of Sullivan & Worcester LLP, the real estate practice group of K&L Gates LLP, and the corporate and real estate practice groups of Duane Morris LLP.
Mr. Mako received his B.A. from Cornell University in 1993, and his J.D., cum laude, from New York Law School in 1999, where he also served as the Managing Editor of the New York Law School Journal of International and Comparative Law. He is admitted to practice law in New York and New Jersey.
